Texas Deceptive Trade Practices Act

The Texas Deceptive Trade Practices Act (DTPA) is a law intended to protect “consumers” from “deceptive” trade practices. A consumer does not need to be an individual. In fact, the court will readily recognize a small business owner as a “consumer.” Despite common belief, you don’t even have to purchase anything to be protected by the DTPA. Any deceptive or fraudulent statement that influences how you contemplate purchasing a product or service is covered under the DTPA.
